    Thank you for choosing Graphia. By using our services, you agree to these terms. Please read this text carefully.

    1. Parties and Acceptance

    These Terms of Service are between Hasan Kırtaş, who operates the service presented as "Graphia" to users under the official name "Graphia Studio", and the person using the service. Graphia is currently operated by Hasan Kırtaş as a natural person. By using the service, you agree to these terms; if you do not agree, you should not use the service.

    2. Description of the Service

    Graphia is a smart, infinite canvas-based workspace where users write directly on the canvas and bring their documents and links together, and where AI understands all of that content and works alongside the user. The service is currently offered for free; if paid tiers are added in the future, these terms will be updated and users will be informed in advance.

    3. Eligibility and Account Creation

    You must be at least 13 years old to use Graphia; users between 13 and 18 are recommended to use the service under parental or guardian supervision (see Privacy Policy, Section 10). You are responsible for keeping your account information accurate and up to date. Sign-in is only available via Google or Microsoft; Graphia does not request a separate username/password from you.

    4. Prohibited Uses

    You cannot use Graphia in a way that violates laws, infringes copyright, or harms the rights of others; engage in activities that harm the infrastructure of the service (including excessive automation, scraping, or denial-of-service attempts); try to gain unauthorized access to someone else's account; or use the AI features to generate illegal, harmful, or deliberately misleading content. Violating this section may result in suspension or termination of your account without prior notice.

    5. Content Ownership

    The intellectual property of all content you add to the platform (including text, documents, images, and links) belongs entirely to you. Graphia cannot use this content for any purpose other than providing service to you (including storage, syncing, and AI processing) and does not claim rights on your content. The responses generated for you by the artificial intelligence are also open to your use. You represent that you have the legal right to share and process your content and that it does not infringe the rights of third parties. By using the service, you grant Graphia a limited, worldwide, royalty-free, non-exclusive license to host, process, and transmit your content solely for the purposes described in these terms and the Privacy Policy (including storage, display, syncing, and AI processing); this license exists only to the extent necessary to provide the service to you and ends when you delete your account.

    6. AI-Generated Content and Third-Party Providers

    Responses generated by artificial intelligence do not always guarantee full accuracy, may not be current, and do not constitute legal, medical, or professional advice. The responsibility to check the accuracy of these outputs and to decide how to use them belongs to the user. AI responses are generated by independent third-party model providers (e.g. OpenAI, Google, DeepSeek, Alibaba/Qwen) accessed through our model-routing infrastructure; those providers' own terms and their uptime or quality commitments are outside Graphia's control. Reasonable usage and rate limits may be applied to AI features to prevent abuse.

    7. Early Access and Service Changes

    Graphia is currently in early access. We may change, remove, or temporarily suspend platform features without prior notice. No liability beyond reasonable care is assumed for data losses that may occur due to technical problems; we recommend that you regularly back up your important content.

    8. Account Security

    You are responsible for the security of your account and for all activity that occurs through it. If you detect unauthorized use, you must notify us immediately via our contact page.

    9. Termination of Service

    You can close your account at any time; your data will be deleted within the period specified in the Privacy Policy. If we determine that you have violated these terms, we may suspend or terminate your account without prior notice. Provisions that by their nature should survive termination (including Content Ownership, Limitation of Liability, Indemnification, and Governing Law) remain in effect.

    10. Intellectual Property

    The Graphia brand, logo, and infrastructure software belong to Hasan Kırtaş. These terms do not grant you any rights on the Graphia brand or software.

    11. Disclaimer of Warranties

    The Graphia service is provided "as is" and "as available", without any warranty, express or implied. No warranty is given that the service will be uninterrupted, error-free, or fit for a particular purpose. Graphia cannot be held directly responsible for interruptions, errors, or data loss caused by third-party infrastructure or model providers (see Section 6).

    12. Limitation of Liability

    To the maximum extent permitted by law, Graphia and Hasan Kırtaş shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of data, profits, or business interruption). Where any liability is found to exist, our total liability is limited to the fees you paid in the preceding 12 months (if any) or, since the service is currently offered free of charge, to zero.

    13. Indemnification

    You agree to indemnify and hold Hasan Kırtaş harmless from any claims, damages, losses, and costs (including reasonable attorneys' fees) arising from your violation of these terms or applicable law, or from content you add that infringes the rights of third parties.

    14. Governing Law and Dispute Resolution

    These terms are governed by the laws of the Republic of Turkey; the courts and enforcement offices of Istanbul (Central) have jurisdiction in case of disputes. For global users, the mandatory consumer protection provisions of their country of residence are reserved.

    15. General Provisions

    If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision is deemed replaced by a valid one that most closely matches its intent. Failure to exercise a right does not constitute a waiver of that right. Graphia may assign its rights and obligations under these terms in connection with a transfer of the service (for example, to a company); users may not assign their rights under these terms without Graphia's prior written consent. Graphia is not liable for delays or failures to perform caused by events reasonably beyond its control, such as natural disasters or infrastructure provider outages. These terms, together with the referenced Privacy Policy, constitute the entire agreement between the parties.

    16. Changes to the Terms

    These terms may be updated from time to time. For significant changes, we will provide reasonable advance notice through the service or via email. Your continued use of the service after changes means you accept the updated terms.
